FAQs
What is the difference between a Grant of Probate and Letters of Administration?
-
A Grant of Probate is issued when there is a valid will and confirms the executor’s authority to administer the estate. Letters of Administration are granted when there is no will, giving a close relative the legal right to manage the estate. Both documents are essential for accessing and distributing the deceased’s assets.
How long does probate usually take?
-
Timescales can vary depending on the size and complexity of the estate, whether inheritance tax is due, and how quickly information is gathered. On average, probate takes between 3 and 18 months, but larger estates or those with overseas assets may take longer. Professional guidance can help reduce unnecessary delays.
Why should I store my will with a solicitor?
-
Storing your will with a solicitor ensures it is kept safe, secure, and easily accessible when needed. It also reduces the risk of the document being lost, damaged, or accidentally destroyed. Many people choose this option for added peace of mind and to ensure executors know exactly where to find the original will.
